Sales of Goods Act still requires goods to be of satisfactory quality. Durability is one of the relevant factors when assessing satisfactory quality. In a consumer purchase, any goods sold that become defective within 6 months of purchase are presumed to have been defective at the point of sale, and the burden of proof is therefore reversed - the vendor has to show they were not defective at the point of sale (and thus supplied in breach of the terms implied into the contract for purchase of the bike that it and its consituent parts be of satisfactory quality).

I'd take the position that the wheel was demonstrably defective when supplied. It should never have bent when being ridden on normal roads within 2 weeks. As to whether you hit something unusual in the road, you're the only witness to that and as you say that you didn't you'll just have to take that position and see what they say.

As to whether the wheel is of substandard manufacture, actually I'd suggest that's probably verifiable irrespective of what you hit - it's going to be to do with the inherent characteristics of the wheel and the metal it's made of, which could be examined by an expert / metallurgist to see whether it was defective / soft and so more susceptible to failure. Unless you (or your legal protection insurer, see below) is prepared to pay for someone independent to do that, your best plan of action is probably to try and persuade the dealer to return the wheel to BMW for analysis and place your trust in BMW doing an honest appraisal of the wheel. The fact that the wheel broke on the jig probably supports the suggestion there's a defect, but unfortunately you may get the answer that going to the wheel repairer without the dealer's agreement means they are not liable because they'll allege the wheel repairer did something wrong.

The best thing to do if you get nowhere with the dealer in trying to get the wheel replaced is probably to check if you have family legal protection cover on any home or other insurance policies that cover you for breach of consumer contract situations - if you do, then subject to any excess your insurer should then instruct a lawyer on your behalf to take up a claim. Again though you might find that unfortunately the fact you went to a repairer before involving the insurer affects the cover decision.

Sorry to hear of your mishap. I BROKE BOTH WHEELS when I clipped a curb exiting from the highway in Texas...not even a year after getting my RS. I didn’t know they were broken until I got the bike on a trailer to haul it home. My avatar is my front wheel...mounted and made into a wall clock. Only cost me about $10K USD.

I can’t attest as to if BMW wheels are “too soft” or not. My ‘99 Honda hit a curb in dense fog. Slow speed, but it threw me so violently that I was certain it would end in crashing. Not a ding. However, I think it’s common for alloy wheels to fracture under sufficient pressure, so maybe a “softer” compound improves the odds of just having a dent that might be fixable to a definite broken wheel. At least with a dent, you may be able to ride the bike to the shop. Broken wheel = tow truck.

Good point. Might be the difference between the wheel deforming on impact or shattering. The former is probably preferable!

My comment may be a bit late, but the comprehensive insurance coverage on my bike took care of replacing the rim & tire when i struck some road debris (chunk of concrete).

I fully agree with what has been stated. I would love to have hit a pothole so I could at least know what to attribute the damage to. I think i'm at the mercy of the dealer, hopefully they will be a little understanding as they themselves recommended the firm to repair the wheel... either way ££££ me thinks

On a similar point. Last winter potholes appeared in some of my local roads which were about the same depth as the radius of a Lambretta wheel. I shudder to think what would happen if you rode into one of those on a scooter. I suspect that you wouldn't be riding away with just a dented rim

Good luck with your wheel rim. I have always found BMW to very reasonable if you approach customer services direct. Sometimes dealers don’t want to rock the boat.

I had the rear brake cotter pin drop out of my first RS with 138 miles on it! That was alarming and could have been disastrous. But a brief email exchange with BMW customer services and I ‘acquired’ a NAV V in compensation.

Many years previously I had a launch BMW X3, a truly disappointing vehicle. I asked the dealer to help, they said they couldn’t. I went direct to BMW to see if they would take it back (after 6 weeks). 24 hrs later they agreed to do so for the full price I paid, provided I replaced it with another BMW. (530d Touring). I’ve been a big BMW fan ever since.

BYW - I hit one of those lambretta wheel sized potholes on the A338 between Salisbury and Tidworth last year. Luckily I was in my car. The impact was stunning! New tyre and alignment, luckily the rim was ok. Wiltshire CC coughed up £236 towards the repair costs.

You've plainly not had the unpleasant experience of riding on public roads in Surrey recently - though to be fair if you have the Scottish roads to play on, why the hell would you want to?! :)

In all seriousness, while it would certainly be open to BMW to claim that, I don't think a Court would struggle to hold that manufacturers selling bikes in Britain have to accept that public roads are far from perfect and are often potholed, and design wheels accordingly, with sufficient strength to withstand a "normal" pothole. After all, ours is a tourer, not a track bike.

The design of wheels is dictated by construction and use criteria set by a national or in the case of BMW, a supra-national body, the EU. If BMW can demonstrate the wheel meets the relevant specification and there is no manufacturing defect where is their liability? The court has no jurisdiction on wheel specification.
